Conciliation at the Ministry of Labour and the Industrial Court is a dispute resolution methodology in which the Conciliator tries to bring the parties to agreement on issues in contention by suggestion, direction and guidance. P.M.S.L’s Consultant’s represent clients during this process.
Conciliation is a formal part of the legal framework provided for dispute resolution in the Industrial Relations Act. If your staff are not trained in this process PMSL can provide support and advice, or can be the spokesperson leading your Company’s team through to the most appropriate outcome.
Arbitration at the Industrial Court takes place when conciliation is unsuccessful. The Arbitrators (Judges) listen to the evidence and arguments put forward by the parties, or by a PMSL Consultant on behalf of a client, and makes a judgment which then, by law, must be accepted. PMSL’s expertise in Industrial Relations law and practice has saved many an employer from an expensive and morale damaging judgment. Should there be no alternative to having a dispute settled at the Court you should be properly represented. PMSL can represent your Company at formal Hearings at the Industrial Court, or can work with Attorneys to ensure that your case has the best representation.
PMSL also provides arbitration services outside the court in sensitive issues such as sexual harassment cases that a company may not wish to have heard in a public forum at the Industrial Court.
Mediation is a process where a sole mediator or a mediation panel, agreed on by the parties, listens to the contentions of both parties to a dispute or a grievance and helps them to come to their own resolution. P.M.S.L. can provide a mediator to chair a mediation panel to facilitate this process.
